These Terms of Use (“Terms”) govern your access to and use of Skillpatch.ai (the “Service”), operated by Viz Data Ltd, UK (“we”, “us”, “our”). By using the Service, you agree to these Terms and our Privacy Policy.

1. Who may use the Service

  • You must be at least 13. If you are under 18, you confirm you have permission from a parent or guardian.
  • If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation and “you” includes that organisation.

2. Your account

  • You must provide accurate information and keep your login details secure. You are responsible for activity under your account.
  • You may close your account at any time by contacting us.

3. Description of the Service and “Beta” status

  • The Service provides educational tools that generate content using artificial intelligence.
  • The Service is provided in a “Beta” stage. This means it is still under active development and testing. Features may change, be suspended, or removed without notice. The Service may experience downtime, outages, or loss of data at any time. You are solely responsible for maintaining your own backups of any important data and should not rely on the Service as your sole repository of information.

4. Acceptable use

  • Do not use the Service unlawfully or to infringe others’ rights.
  • No reverse engineering, scraping, bulk exporting, or rate-abuse.
  • Do not upload special-category or highly sensitive personal data unless we explicitly permit it.
  • Do not attempt to bypass security or interfere with the Service’s operation.

5. AI outputs and your responsibilities

  • AI-generated content can be inaccurate, incomplete, or inappropriate. It is provided for educational purposes only and is not professional advice.
  • You are responsible for reviewing and using outputs appropriately and for complying with laws applicable to your use of the outputs.
  • You must not rely on the Service for legal, medical, financial, or other regulated advice.

6. Your content

  • You retain rights to content you submit and outputs you lawfully create using the Service, subject to third-party rights.
  • You grant us a worldwide, non-exclusive licence to host, process, display and use your content as needed to operate and improve the Service.
  • You confirm you have necessary rights to submit the content and that it does not infringe others’ rights.

7. Our intellectual property

  • The Service, site design, software, and trademarks are owned by us or our licensors and are protected by law.
  • We grant you a limited, revocable, non-transferable licence to use the Service for your internal, lawful purposes.

8. Privacy

  • Our processing of personal data is described in our Privacy Policy. By using the Service you acknowledge that policy.

9. Fees

  • During Beta the Service may be free or offered on a trial basis, or for reduced cost. We may introduce fully paid plans in the future.

11. Warranties and disclaimers

  • The Service is provided “as is” and “as available” without warranties of any kind, express or implied.

  • We do not guarantee availability of the Service, and you acknowledge that the Service may be interrupted, discontinued, or suffer data loss at any time.

12. Liability

  • To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, or goodwill.
  • Our total liability for any claim relating to the Service is limited to the greater of £100 or the fees you paid to us for the Service in the 12 months before the event giving rise to liability.
  • Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

  • You agree to indemnify us against claims, losses, and costs arising from your content, your use of the Service, or your breach of these Terms.

  • We may assign these Terms and transfer our rights and obligations (including related data. in connection with a merger, acquisition, or sale of assets or as a going concern. The recipient will honour terms that are no less protective than these Terms and our Privacy Policy.
  • You may not assign your rights or obligations under these Terms without our consent.

18. Governing law

  • These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except that consumers resident elsewhere in the UK or EU may have mandatory local rights.

19. Entire agreement

  • These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede prior understandings.
